In these cases, the defendants claim that a section of Colorado's vehicular homicide statute, prior to its amendment in 1989, was vague and therefore void under the due process clauses of the Colorado and United States Constitutions. Gonzales failed to preserve the void for vagueness issue at trial; we therefore dismiss the writ of certiorari as improvidently granted in his case.*fn1 As to Rickstrew, because we find no infirmity in the statute, either facially or as applied to him, we affirm the court of appeals.
